 of Warranty

1. Limited Warranty

The warranty described in this document applies exclusively to +kouple lighting products.

This warranty is exclusively applicable to the party who purchases the Products directly from +kouple (hereafter: “Purchaser”).

Only the Purchaser may use the warranty.

+kouple guarantees that each Product is exempt from defects in materials and workmanship for the period and under the terms and conditions set out below. In the event of failure of the Product, in compliance with this warranty, +kouple will, at its discretion, replace or repair free of charge, or refund the defective Product in accordance with the applicable terms and conditions of the limited warranty set out below. 


2. Terms and Conditions

The +kouple warranty applies exclusively to the Purchaser.
 


The warranty runs from the date of the invoice with which the Product was acquired by the Purchaser from +kouple and ends after 24 months.



The Product covered by this warranty is subject to examination, +kouple determines that the Product is defective, at its discretion, will repair, replace, return, refund the purchase price, or provide a replacement of the Product components.



 Where the Product is replaced, the warranty on the replacement Product commences from the date of purchase of the original replaced Product.



For clarity, "the repair or replacement of the Product or the defective part" does not include the removal or reinstallation, costs, or charges, including, by way of example and without limitation, labor costs and charges.




No agent, distributor, or retailer is in any way authorized to change, modify or extend the terms

of this limited warranty on behalf of +kouple.



This limited warranty applies only where the Product has been correctly wired, installed, and used within the electrical values, operating range, and environmental conditions indicated in the specifications, in the application guidelines.



For lamps with integrated LEDs, the following limitation applies with regard to their warranted and orderly lighting function: Given the current state of technology the lighting performance of LEDs may diminish in the course of their life cycle, but it does not suddenly fail. 

This aging process (degradation) is primarily down to thermal influences on the crystal and is completely normal for LED technology. This is use-conditioned wear and tear.

At the end of their life the LEDs are still fully functioning but with lower light performance.

This means that a reduction in the lighting effect of the LED lamps within their lifespan in the 

aforementioned scope does not represent a fault in accordance with the current state of science and technology.

This warranty does not apply to defects or non-conformity deriving from any cause of force majeure or from any abuse, improper or anomalous use, or use in violation of any applicable standard, code, or instructions for use, including, by way of example and without limitation, those contained in the most recent safety rules, industry standards and/or electrical guidelines for the specific country/countries.



 This warranty does not apply to light bulbs and drivers which are not products manufactured by +kouple and supplied by +kouple only as included parts.

The warranty does not apply if and/or when:
 


• A repair and/or modification has been made by any person to the Product that has not been duly authorised in writing by +kouple


• The Product has been installed incorrectly or not in compliance with the instructions;


• Additions, conversions or other modifications have been made to the product;


• The Product is used improperly;


• The Product is badly or insufficiently maintained;


• The maintenance, care and use of the product has occurred according to the instruction manual;


• Damage is caused to the Product by accidents and/or force majeure, including, but not limited to, lightning, abnormal voltage, water, fire, natural disasters or extreme operating conditions (such as use in coastal areas, industrial or agricultural environments);


• Damage is caused by transportation of the Product, from the delivery address indicated by the Purchaser to other places or to third party entities


• The Purchaser fails to report transportation damage to the carrier.


• Damage caused by animals; 


3. Use of the Warranty

Uses of the warranty must be reported and sent to the +kouple within 7 days of discovering the defect, specifying the following information:


• Date and number of Invoice or receipt


• Date and the number of the delivery document of the material 


• Detailed description of problem and quantity of defective Products


• Photographs of the defect and the label of the Product on the packaging

+kouple may charge to the Purchaser the costs for any returned Products that are not found to be defective or non-compliant, together with the associated handling, verification and transportation costs. 


4. Limitations, exclusions, and conditions

This is a limited warranty and excludes, inter alia, the installation, means of access to the Products (scaffolding, hoists, etc.), and special, incidental, and consequential damages (such as, for example, the loss of economic profits/loss of earnings, property damage or other extended costs not previously mentioned) and is further defined by the limitations and by the conditions set out in the respective warranty and in these terms and conditions.

+kouple may not be held liable for the power supply conditions, including power surges, over/under voltage, and current control systems that exceed the specified limits of the Products and exceed those defined by specific power supply specifications.


In relation to the Products sold to the Purchaser by +kouple does not offer warranties of any nature, express or implicit, including, by way of example and without limitation, warranties of merchantability or suitability for a specific purpose, but will provide to the Purchaser, upon request, exclusively to the maximum extent permitted by law and by the respective contracts, the warranties of the manufacturer of the Product in question.

UA / Умови та положення гарантії

1. Обмежена гарантія

Гарантія, описана в цьому документі, поширюється виключно на освітлювальну продукцію компанії +kouple.
Ця гарантія поширюється виключно на сторону, яка купує Продукцію безпосередньо у компанії +kouple (далі по тексту – «Покупець»).

Гарантією має право користуватися виключно Покупець.
Компанія +kouple гарантує протягом періоду та відповідно до положень і умов, вказаних нижче, що уся продукція не містить будь-яких дефектів матеріалів або виготовлення. У разі несправності продукту, відповідно до цієї гарантії, компанія +kouple на власний розсуд безкоштовно замінює або здійснює ремонт, або відшкодовує вартість, дефектного продукту відповідно до застосовних положень та умов обмеженої гарантії, викладених нижче.

2. Положення та умови

Гарантія компанії +kouple поширюється виключно на Покупця.

Гарантія діє з дати виставлення рахунку, за яким Покупець придбав Продукт у компанії +kouple, і її строк закінчується через 24 місяці після цієї дати.

Продукт, на який поширюється ця гарантія, підлягає перевірці, в ході якої компанія +kouple визначає, що Продукт є дефектним, і на свій розсуд здійснює ремонт, заміну, повернення, відшкодування вартості покупки або заміну компонентів Продукту.

У разі заміни Продукту строк гарантії на замінений Продукт починається з дати придбання оригінального Продукту, який був замінений.

Для уникнення неоднозначного тлумачення уточнюємо, що «ремонт або заміна Продукту або несправної частини» не включає демонтаж або повторне встановлення, витрати або видатки, в тому числі, наприклад, серед іншого, витрати та видатки на оплату праці.

Жоден представник, дистриб’ютор чи роздрібний продавець не має будь-яких повноважень змінювати, модифікувати або розширювати умови цієї обмеженої гарантії від імені компанії +kouple.

Ця обмежена гарантія поширюється лише на випадки, коли Продукт був належним чином підключений, встановлений та використовувався у відповідності зі значеннями електричних параметрів, робочого діапазону та умов навколишнього середовища, вказаних у специфікаціях та інструкціях з експлуатації.

Для ламп із інтегрованими світлодіодами застосовуються наступні обмеження стосовно гарантії та забезпечення належної функції освітлення: з урахуванням поточного рівня технологій, світлова потужність світлодіодів може зменшуватися протягом періоду експлуатації, але вони не виходять з ладу раптово.

Такий процес старіння (деградація) пов’язаний переважно з впливом температур на кристал і є цілком нормальним для технології світлодіодів. Це знос, зумовлений використанням.

Після закінчення терміну служби світлодіоди все ще повністю функціонують, але мають знижені світлові характеристики.
Це означає, що зниження світлових характеристик світлодіодних ламп протягом періоду їх експлуатації у вищезгаданому обсязі не є несправністю відповідно до сучасного рівня науки та техніки.

Ця гарантія не поширюється на дефекти чи невідповідності, що виникли внаслідок форс-мажорних обставин або будь-якого зловживання, неналежного або неправильного використання, або використання з порушенням будь-яких застосовних стандартів, приписів чи інструкцій з експлуатації, зокрема, наприклад, серед іншого, тих, які вказані в актуальних правилах безпеки, галузевих стандартах і/або інструкціях з електрики, що діють в конкретній(-их) країні/країнах. Ця гарантія не поширюється на лампочки та драйвери, які не відносяться до продукції, що виготовляється компанією +kouple, і постачається компанії +kouple лише як складові частини.

Гарантія не поширюється на такі випадки:

• Був виконаний ремонт та/або модифікація Продукту будь-якою особою, на який не було отримано належного письмового дозволу від компанії +kouple;

• Продукт був встановлений неправильно або не відповідно до інструкцій;

• До продукту були внесені доповнення, виконані перетворення або зроблені інші модифікації;

• Продукт використовується неналежним чином;

• Продукт обслуговується неналежним чином або в недостатньому обсязі;

• Технічне обслуговування, догляд і використання продукту відбувалися відповідно до інструкції з експлуатації;

• Пошкодження Продукту викликано нещасним випадком та/або форс-мажорними обставинами, в тому числі, серед іншого, блискавкою, напругою з відхиленням від необхідного значення, водою, пожежею, стихійним лихом або екстремальними умовами експлуатації (наприклад, використання в прибережних районах, промисловому або сільськогосподарському середовищі);

• Пошкодження спричинено транспортуванням Продукту з адреси доставки, вказаної Покупцем, до іншого місця або до третіх осіб;

• Покупець не повідомляв перевізнику про пошкодження під час транспортування;

• Пошкодження, завдані тваринами.

3. Використання гарантії

Про використання гарантії необхідно повідомити та надіслати таке повідомлення компанії +kouple протягом 7 днів після виявлення дефекту, вказавши таку інформацію:

• Дата та номер рахунка або квитанції

• Дата та номер акту прийому-передачі матеріалу

• Детальний опис проблеми та кількість бракованих Продуктів

• Фотографії дефекту та етикетки Продукту на упаковці

Компанія +kouple має право стягнути з Покупця витрати за будь-які повернуті Продукти, в яких не було виявлено дефектів або невідповідностей, разом із відповідними витратами на обробку, перевірку та транспортування.

4. Обмеження, виключення та умови

Ця обмежена гарантія виключає, зокрема, встановлення, засоби доступу до Продуктів (підйомники тощо), а також спеціальні, випадкові та побічні збитки (такі як, наприклад, втрата економічної вигоди/ втрата заробітку, пошкодження майна чи інші додаткові збитки, не згадані раніше), а також в подальшому визначається обмеженнями та умовами, викладеними у відповідній гарантії та в цих положеннях і умовах.

Компанія +kouple не несе відповідальності за умови електропостачання, в тому числі стрибки напруги, підвищену/знижену напругу та системи контролю струму, які перевищують ліміти, встановлені для Продуктів, а також ліміти, що визначені специфікаціями конкретного джерела живлення.

Стосовно Продуктів, проданих Покупцеві, компанія +kouple не надає будь-яких гарантій, явних чи неявних, в тому числі, наприклад, серед іншого, гарантій придатності для комерційного використання або придатності для певної мети, але надає на вимогу Покупця, виключно в максимально дозволеному законом і відповідними договорами обсязі, гарантії виробника щодо цього Продукту.
